
Terms and Conditions
1. SCOPE OF APPLICATION:
These General Terms and Conditions (GTC) apply to all offers and services provided by Sky Valet. Conflicting or deviating terms and conditions of the customer will only be recognized if Sky Valet has expressly agreed to them in writing. The GTC also apply if Sky Valet performs services without reservation while being aware of the customer's deviating terms and conditions.
1.1 Applicability of the Terms
The General Terms and Conditions (GTC) apply exclusively to all offers and services provided by PS Taxi und Mietwagen GmbH. Unless PS Taxi und Mietwagen GmbH has expressly agreed in writing to their applicability, PS Taxi und Mietwagen GmbH does not recognize any conflicting or deviating customer terms and conditions. If PS Taxi und Mietwagen GmbH performs services without reservation while being aware of conflicting or deviating terms and conditions of the customer, these GTC shall also apply.
1.2 Offers and Conclusion of Contracts
PS Taxi und Mietwagen GmbH provides free offers. PS Taxi und Mietwagen GmbH must confirm the customer's booking (booking request) before a contract can be concluded. To enter into an effective contract between the customer and PS Taxi und Mietwagen GmbH, the customer must accept these General Terms and Conditions. Employees and other agents of PS Taxi und Mietwagen GmbH are not authorized or empowered to make oral agreements outside the written contract content, unless they have legal representation authority, such as procuration or authorized management positions.
The fees for shuttle or valet services must be paid by the customer.
2.1 PS Taxi und Mietwagen GmbH allows passengers at Frankfurt am Main Airport to park their vehicle on the company's parking lots for a fee and to use the free shuttle service to the airport. PS Taxi und Mietwagen GmbH endeavors to transport customers punctually to the specified departure time, but timely arrival is not part of the contract. Liability for delays or damage to luggage during the shuttle service is excluded.
2.2 A parking space booking request with PS Taxi und Mietwagen GmbH results in a rental agreement between the customer and PS Taxi und Mietwagen GmbH. This contract does not include guarding or storage. PS Taxi und Mietwagen GmbH has no special duty of care or custody for the items brought by the customer.
2.3 PS Taxi und Mietwagen GmbH is obliged to provide the customer with the booked parking space(s) for the agreed duration. The customer has no claim to a specific parking space unless it is a long-term rental, in which case the customer will be assigned a fixed parking space.
2.4 PS Taxi und Mietwagen GmbH has a right of retention and lien on the customer's vehicle. If the vehicle is not removed after the end of the rental period, the rental agreement is not automatically extended. PS Taxi und Mietwagen GmbH may demand compensation for the period until removal and reserves further claims, including the removal of the vehicle at the customer's expense.
2.5 PS Taxi und Mietwagen GmbH may refuse to release the parked vehicle without prior payment of the invoice amount.
2.6 Valet Parking: An employee of PS Taxi und Mietwagen GmbH will receive your vehicle at the agreed location at the airport terminal and either park it on the company premises or bring it to the airport. Your vehicle must be roadworthy, insured, with official license plates and a valid inspection sticker. If the vehicle is refused acceptance, the customer remains obligated to pay the agreed remuneration. It is recommended to bring the spare key for the car.
3. Conduct on the Company Premises
3.1 The regulations of the German Road Traffic Regulations (StVO) apply on the premises of PS Taxi und Mietwagen GmbH. Driving is only permitted at walking speed, traffic signs must be observed, and staff instructions must be followed. Endangering third parties must be avoided. Vehicles may only be parked in marked parking spaces without obstructing others. If a parking space is assigned, it must be used. PS Taxi und Mietwagen GmbH may remove incorrectly parked vehicles at the customer's expense.
3.2 Without the express consent of PS Taxi und Mietwagen GmbH, the customer is prohibited from carrying out repairs, washing vehicles, draining operating fluids, disposing of waste, or storing items on the company premises. Vehicles with leaking tanks or engines may not be parked. Contamination caused by the customer must be removed immediately, otherwise PS Taxi und Mietwagen GmbH will do so at the customer's expense. In case of soil or groundwater contamination, a specialist company must carry out the cleaning at the customer's expense; self-cleaning is not permitted.
3.3 Staying on the premises of PS Taxi und Mietwagen GmbH for purposes other than parking and picking up vehicles, loading and unloading, and during possible waiting times for the shuttle is not permitted. PS Taxi und Mietwagen GmbH is entitled to refuse the parking of vehicles on the premises in case of imminent danger and to remove vehicles from the premises in case of urgent danger.
3.4 The customer assures that the driver has a valid driver's license and that the vehicle is insured until leaving the company premises. Upon request, the driver's license and vehicle registration document must be presented. If there is a suspicion of lack of insurance coverage, PS Taxi und Mietwagen GmbH may request proof. If the documents are not presented, PS Taxi und Mietwagen GmbH may refuse the service without the customer having any claim for damages.
3.5 Smoking is prohibited on the premises of PS Taxi und Mietwagen GmbH. Smoking is only permitted in marked areas.
4. Shuttle Service
4.1 Together with the rental of a parking space on the premises of PS Taxi und Mietwagen GmbH, the company provides a free shuttle service from the premises to Frankfurt am Main Airport and back. Customers are obliged to appear at the departure point at the specified time. Delays will result in the loss of the shuttle service.
4.2 The luggage of the customer and their companions will be transported free of charge up to the quantity and weight set by the charter and airline companies for free transport. PS Taxi und Mietwagen GmbH is only obliged to transport excess luggage after special agreement. Special luggage must be announced at the time of booking.
4.3 The shuttle service is usually provided individually according to the customer's departure and arrival times. However, PS Taxi und Mietwagen GmbH reserves the right to provide collective transport, even if this results in reasonable delays (usually up to 30 minutes) for the customer in individual cases. Short-term changes to departure and arrival times must be indicated by the customer. It should be noted that PS Taxi und Mietwagen GmbH must first confirm in writing to the customer whether it can offer a shuttle service for changed departure and arrival times.
4.4 Transport to Frankfurt am Main Airport is usually provided directly to the terminal hall where the check-in counter for the customer's flight is located. The departure and arrival times must be indicated by the customer in the reservation request. The return transport from Frankfurt am Main Airport to the company premises is usually provided promptly. The customer must notify the company by phone after landing and collecting their luggage.
4.5 PS Taxi und Mietwagen GmbH is entitled to refuse transport to intoxicated or disruptive persons, excluding any claims for damages by the customer for non-performance or poor performance.
4.6 Upon request, PS Taxi und Mietwagen GmbH provides child seats if the customer indicates this and the number at the time of the booking request and PS Taxi und Mietwagen GmbH confirms the corresponding reservation with the booking acceptance.
4.7 The regulations of the German Road Traffic Regulations (StVO) apply on the parking lot. PS Taxi und Mietwagen GmbH is not liable for damages caused by natural events, force majeure, other tenants, or other third parties.
4.8 The return transport from Frankfurt am Main Airport to the premises of PS Taxi und Mietwagen GmbH is usually provided promptly. The customer must notify the company by phone after landing and collecting their luggage.
4.9 PS Taxi und Mietwagen GmbH is entitled to refuse transport to intoxicated or disruptive persons, excluding any claims for damages by the customer for non-performance or poor performance.
4.10 Upon request, PS Taxi und Mietwagen GmbH provides child seats if the customer indicates this and the number at the time of the booking request and PS Taxi und Mietwagen GmbH confirms the corresponding reservation with the booking acceptance.
5. Vehicle Services
5.1 PS Taxi und Mietwagen GmbH allows customers who rent a parking space on the company premises to use vehicle services and windshield repair services for the parked vehicles for a fee. Corresponding booking requests from customers can usually only be considered if the customer's request is made at least one week before the start of the parking period.
5.2 The vehicle services booked by the customer will be carried out during the parking period of the customer's vehicle. Therefore, the customer must hand over the vehicle key in time.
6. Hotel Requests
6.1 PS Taxi und Mietwagen GmbH offers customers who rent a parking space on the company premises the opportunity to make requests for hotel accommodations through PS Taxi und Mietwagen GmbH. However, PS Taxi und Mietwagen GmbH does not assume any obligations towards the customer in this regard, neither with regard to a mediation obligation nor with regard to a accommodation contract. Any contractual relationships exist solely between the customer and the hotel.
7. Prices and Payment Terms
7.1 The customer is obliged to pay the agreed prices to PS Taxi und Mietwagen GmbH.
7.2 Prices stated by PS Taxi und Mietwagen GmbH are gross prices.
7.3 The daily prices per calendar day apply for the parking services offered by PS Taxi und Mietwagen GmbH, even if the customer only uses the offered parking services for part of the respective calendar days.
7.4 The agreed prices will be invoiced to the customer at the beginning of the parking period and are to be paid immediately and without deduction in EURO.
7.5 If the customer does not accept the agreed services of PS Taxi und Mietwagen GmbH, the customer remains obliged to pay the agreed fee to PS Taxi und Mietwagen GmbH, subject to contrary legal regulations.
7.6 The customer may not offset claims of PS Taxi und Mietwagen GmbH with counterclaims unless the counterclaim is undisputed, legally established, or recognized by PS Taxi und Mietwagen GmbH.
8. Withdrawal
8.1 The customer is granted a right of withdrawal under the following conditions.
8.2 The customer may withdraw from the contract at any time in writing, by fax, or by email until the start of the rental period. Withdrawal up to 24 hours before the start of the rental period is free of charge. If the withdrawal is made later, the full amount is to be paid as compensation. In the "Best Price" tariff, the full price is refunded. The customer can prove that no or a lesser damage has occurred. The compensation is limited to the agreed rental price.
8.3 Statutory rights of withdrawal and termination of the parties remain unaffected by the above provisions.
9. Liability
9.1 PS Taxi und Mietwagen GmbH is liable according to statutory provisions for damages resulting from intent or gross negligence of PS Taxi und Mietwagen GmbH as well as from intent or gross negligence of the representatives or vicarious agents of PS Taxi und Mietwagen GmbH.
9.2 If the customer is an entrepreneur, the liability of PS Taxi und Mietwagen GmbH in case of gross negligence is limited to the foreseeable, typically occurring damage at the time of conclusion of the contract.
9.3 If other uninvolved vehicles are damaged by the vehicle, the statutory provisions apply to the other damaged vehicles. In this case, the motor vehicle liability insurance of the person causing the accident is liable for all subsequent damages.
9.4 In case of an accident or damage caused by the driver or vicarious agent, the liability does not lie with PS Taxi und Mietwagen GmbH, but with the liability insurance of the person causing the accident. PS Taxi und Mietwagen GmbH is released from any liability.
9.5 Vandalism, storm damage, tire damage or damage caused by air and pressure loss of any tires, electronic or technical damage, theft of vehicles, vehicle parts, and property damage by third parties as well as damage caused by force majeure, internal and external unrest, elemental natural forces, and war events are not insured.
9.6 If no complaints are raised or no defects are reported when picking up the vehicle and the company premises or the agreed job site is left, PS Taxi und Mietwagen GmbH is not liable for damages or losses, both inside and outside the vehicle.
9.7 PS Taxi und Mietwagen GmbH is not liable for valuables that do not belong to the regular vehicle equipment.
9.8 PS Taxi und Mietwagen GmbH is not liable for damage to the vehicle if the customer does not take photos at the pickup location documenting the current condition and the parking date. This applies to shuttle service and valet service.
9.9 By signing the vehicle return, the customer confirms that there are no new damages to the vehicle.
9.10 PS Taxi und Mietwagen GmbH is liable according to statutory provisions if PS Taxi und Mietwagen GmbH culpably violates an essential contractual obligation. In this case, the liability of PS Taxi und Mietwagen GmbH is limited to the foreseeable, typically occurring damage.
9.11 Liability for culpable violation of life, body, or health remains unaffected; this also applies to mandatory liability under the Product Liability Act, statutory liability regardless of fault, and claims of the customer that arose before the conclusion of the contract.
9.12 Unless otherwise regulated above, the liability of PS Taxi und Mietwagen GmbH is excluded. In particular, it should be noted that PS Taxi und Mietwagen GmbH is not liable for glass damage to the customer's vehicle. Minor damage to the vehicle is not documented before the vehicle is handed over, so liability of PS Taxi und Mietwagen GmbH is also excluded in this case.
9.13 The customer is liable regardless of fault for all damages resulting from technical defects caused by the vehicle brought by him or by third parties commissioned by him to the premises of PS Taxi und Mietwagen GmbH.
9.14 The customer already now assigns his own claims against third parties or insurance companies from a damage event caused by him or due to a technical defect of the vehicle in advance to PS Taxi und Mietwagen GmbH, insofar as PS Taxi und Mietwagen GmbH has suffered damage.
9.15 PS Taxi und Mietwagen GmbH is not liable for fire damage or theft of the vehicle during the agreed parking period.
9.16 In no case is PS Taxi und Mietwagen GmbH liable for accidents caused by the driver or customer on the parking lot premises with property and/or personal damage.
9.17 The parking of the vehicle on one of the parking spaces provided by PS Taxi und Mietwagen GmbH is at the customer's own risk.
9.18 PS Taxi und Mietwagen GmbH is not liable for the loss of items from the interior of the vehicle and the trunk.
9.19 PS Taxi und Mietwagen GmbH is not liable for items in the vehicle, also not in valet service or shuttle service.
9.20 In case of damages arising in the service of pick-up and valet parking at Frankfurt Airport, the liability insurance of the vehicle owner must be used exclusively in any damage cases.
9.21 If the handover takes place in the dark, with a rain-wet or heavily soiled body, subsequent complaints about small scratches on the paint are excluded.
9.22 Liability for damage to the vehicle is limited to contract-typical, foreseeable damage. Liability for damages resulting from a special feature of the vehicle that was not pointed out at the time of handover is excluded.
9.23 PS Taxi und Mietwagen GmbH reserves the right to park vehicles on a secondary parking lot or public parking lot in case of overbooking and to park them there during the rental period. Likewise, PS Taxi und Mietwagen GmbH may cancel reservations at any time, even already paid parking spaces.
10. Withdrawal from the Contract, Withdrawal from a Parking Space Reservation
10.1 PS Taxi und Mietwagen GmbH reserves the right to withdraw from the contract or parking space reservation at any time, even after a successful booking, at its discretion in case of overload.
10.2 PS Taxi und Mietwagen GmbH is not obliged to accept the contract on site after a booking and after online payment. The parking space reservation can be withdrawn or rejected at any time.
11. Release of the Vehicle
11.1 The vehicle will only be released to the client or authorized person after payment of the remuneration. The remuneration can only be paid in cash. Release to third parties is only possible upon presentation of a power of attorney issued by the client or authorized person and corresponding identification (ID card/passport).
12. Incorrect Vehicle Handover
12.1 If the vehicle is handed over to another provider, although a booking confirmation from PS Taxi und Mietwagen GmbH is available, PS Taxi und Mietwagen GmbH is not liable for the return of the vehicle or for any resulting damages or financial losses, this applies to valet shuttle service.
13. Severability Clause
13.1 If individual provisions of this contract, including this regulation, are or become wholly or partially invalid, the validity of the remaining clauses remains unaffected. The invalid provisions shall be replaced by the respective statutory regulation that comes closest to the regulatory purpose of the invalid clause.
14. Applicable Law, Place of Performance, and Jurisdiction
14.1 The laws of the Federal Republic of Germany shall apply exclusively.
14.2 The place of performance is the registered office of PS Taxi und Mietwagen GmbH in Frankfurt am Main, unless another place of performance has been expressly agreed.
14.3 The place of jurisdiction is Frankfurt am Main.
